Gay adoption in California is quite complex. In the year 1985, the California Supreme Court allowed gay couples to adopt the biological children of their other partners; however the decision was terminated in 2002 by a local court in San Diego stating the second parents had no reasons to be considered as legal parents of the children. However, in 2005, the Supreme Court of California ruled that both of the parents of a gay couple would be considered mothers of the child even after the separation of the couple.
While the heterosexual couples are allowed to adopt children of other people who are not alive in this world or who themselves have presented them for adoption for some reasons, the gay and lesbian couples are also allowed in many states of America to adopt orphans. However, it is something else that these couples have to face lot of challenges and obstacles in making their families through this way. The law experts, in this regard, say that there have been three forms through which a gay couple may adopt a child. A gay couple may either get a child jointly, or one of the partners may file a petition in the court to adopt other partner’s biological child. As a third option, an individual gay person may contact court for adoption.
Will Gay Parents Affect The Behaviour Of The Child?
There have been many debates around the world on this topic where people have been putting light on the importance and effectiveness of this idea, however there are just 14 countries which have legalized gay, lesbian, transgender and bisexual adoptions. People raise questions about the personal abilities of these couples asking if they really have capabilities to be good, natural parents. The experts in the fields of medical and psychology say that it has found that the children who are raised and brought up by a gay couple are actually the same in behaviour and personality as raised by a heterosexual couple. Various studies have been conducted by different organizations which have tried to know if there is any difference between children who are brought up by heterosexual parents and gay parents. The results of most of these studies are satisfactory in a way that they show no difference in both of these children which shows that the gay and lesbian parents have same parenting skills as other parents. The parents’ sexual orientation does not affect the personality of the adopted child.
How can a gay couple adopt child in California:
There are various agencies which are working for gay adoption in California. They not just prepare your documentation but they also present your case before court as well. There is a long list of agencies which are working in California for this purpose and they also promote them through advertisements. In California, gay couples may use any of the three options stated above for adopting a child. Everything will be done by these agencies which present your case before local judge. They make case strong by mentioning in the papers that the adopting parents have good character and they have abilities to raise child in good manner. The expectant parents are not needed to have their own home, but they should have place for the child. Their case would be considered pretty strong if they are above 40.
General support and opposition about gay adoption in California:
Ever since the question of gay adoption in Californiahas risen, people are giving mixed reaction, where some go in its favour while others
oppose it. The people, who are in favour of gay adoption, say that there are thousands of little children who are looking towards us for help and who desperately want to be a part of family. They say when it has been found that the sexual orientation has no effect on the personality of the adopted child, then why people do not support it. Other people, who are against this idea, say that the rate of drug addiction and suicide is pretty high in homosexual parents so we should not allow these people to have children because the personal lifestyle of an addicted couple might cause difficulties for the child.
The Catholic religious group had presented a report on this matter in 2004 in which they stated that the rate of child abuse was pretty higher in gay parents than heterosexual stepparents. However, the American Psychological Association says that they have found no such things in their own studies. They even say that they have found that the rate of child abuse is least in lesbian couples. On the basis of these evidences which they have gathered through different studies, the American Psychological Association has decided to support same-sex couples’ adoption. The American Medical Association has also taken a step in this regard and they have also issued a report in which they have mentioned that there is nothing wrong if a gay couple requests court to adopt a child.
Rights and duties of gay parents:
After getting the status of legal parents, the gay couples have the same rights and duties about the child as of a heterosexual couple. They can take decisions about the education and health of the child, and they will be considered responsible if something wrong happens with the child.
Public Opinions and Polls:
A poll conducted by Pew Research Center in 2006 showed that the American people were closely divided on the matter of gay adoption. The next year, the same questions were raised by CNN and Opinion Research Corp. in shape of poll, where the 57% people said that the gay people should have rights to adopt children, while 40% opposed this idea. The situation was also almost the same in United Kingdom as well where 64% people said that the gay couples should be allowed to adopt children.
